Find San Jose criminal court records through the correct court route

San Jose criminal court records are handled through the Santa Clara County Superior Court criminal records process. The Hall of Justice at 190 West Hedding Street, San Jose, California handles criminal matters for San Jose.

For cases filed in 2004 or later, use the criminal case index search with either the defendant name and date of birth or the defendant name plus the month and year the case was filed. For cases before 2004, the court directs users to a microfiche search using the defendant name, defendant date of birth, and filing year. If a clerk search is needed, send or take a letter to the filing clerk with the defendant name, date of birth, and years to search. If an index search does not locate the needed case, especially for older cases, change the retrieval route rather than assuming that no case exists.

A case number is required to inspect or copy Santa Clara County criminal court records. If the index search does not provide the case number, use the applicable court retrieval route before requesting documents.

Once you have the case number, request the specific documents you need and identify the case number, defendant name, date of birth, and document type. Not every document in a criminal file is public.

Request Santa Clara County criminal court documents

After locating the case number, request the specific documents you need by letter to the filing court. Include the case number, defendant name, defendant date of birth, and the document type requested. If your reference is only an arrest or incident number, resolve the court case identifier before assuming it can be used as the clerk's file number. State whether you need a certified copy. A minute order request should identify the specific court date for the requested minute order.

Choose the document based on the purpose of the request. Examples include a minute order, docket, sentencing document, or complaint. A request for an outcome document should identify the exact document needed rather than requesting a general criminal file.

Certified copies, fees, and return instructions

If you need a certified copy, request certification with the document request. Santa Clara County Superior Court fees include $0.50 per page for copies, $40 for certification of a copy, and $15 for a records search performed by court staff that takes longer than 10 minutes. These charges apply to the stated court-record request services and do not replace case-specific retrieval requirements.

For mailed requests, send the request to the criminal records mailing route: Criminal Clerk’s Office, 191 North First Street, San Jose, CA 95113. Checks should be payable to the Clerk of the Superior Court and include the case number in the payment memo. Include a self-addressed stamped envelope for returned copies. When the page count is unknown, a requester may provide a not-to-exceed amount such as $10 as an example cap; this is not a universal fee.

Understand court-file limits

Not every document in a criminal file is public. Some records or documents may be restricted, including certain victim information, probation reports, protective orders involving minor victims, and criminal history information.

If the index does not provide the case number, use the applicable retrieval route before requesting documents. If you have a known case number but need a specific document, contact the Clerk's Office with the case number and document details for the appropriate request route. A missing index result or unavailable document does not by itself mean that no case exists.

Request San Jose police reports separately from court records

A San Jose criminal court search does not provide the police narrative or incident report. Police reports are agency-held records, and another investigating agency holds its own reports. SJPD reports should be requested through the appropriate San Jose Police Department report route, including its Open Records Center and report-order options.

For SJPD report requests, use the Crime/Incident Reports route or the Report Request Form route when applicable. Provide the requester name, address, phone number, date of birth, and available report or incident number, date, time, location, report type and involved parties. One report request form should be used per report. The report request form requires a photo-ID copy, reason for the request, signature and date. Authorized representatives of a victim need the victim’s signed authorization and applicable supporting relationship or release documents.

Release depends on the applicable eligibility and authorization rules. Victims, authorized representatives, qualifying insurance carriers, qualifying injury/loss parties and their attorneys may have request routes identified by incident-report instructions. Suspects or arrested parties should request through their attorney or the Santa Clara County District Attorney route at 408-299-7400. SJPD may restrict release for safety, investigation or privacy reasons.

Online inquiry timing is separate from fulfillment: incident reports require waiting at least 30 days from the incident before online inquiry. Sensitive incident reports cannot be released online and must be handled by mail or in person. Ordinary retention is generally ten years with longer periods for specified sensitive cases. Current incident-report payment instructions use accepted checks or money orders from a U.S. bank, with a check payable to City of San Jose marked not to exceed $16.00; this is not a universal flat report fee. Page charges and applicable costs depend on the request. Manual requests include photo ID and self-addressed stamped envelope instructions. Use a San Jose Police Clearance Letter only for its intended purpose

A Police Clearance Letter is a limited SJPD product for immigration or international travel purposes. It is not a court judgment, a criminal case file, or a replacement for a police incident report.

The request is for current or former San Jose residents and requires a valid government photo ID copy. Choose immigration or international travel as the request purpose and complete the official identity fields, including full legal or other names, date of birth, current and previous addresses, and contact information. If an SJPD arrest record exists, the requesting consulate or agency information is required for processing. An immigration A-number is optional unless the request type specifies it.

The listed current fee is $26 and is nonrefundable. Send the completed form, payment payable to City of San José, and required ID materials to SJPD Operations Support Services Division, 201 W Mission Street, San José, CA 95110. Completed letters are mailed to the current address provided on the request unless the immigration USCIS exception applies.

If an SJPD arrest record exists and the immigration clearance letter is required, SJPD sends the letter directly to USCIS. The older printable form may display a $24 fee, but current instructions and schedule use $26; readers should follow the current fee rather than the outdated form amount.
